GENERAL TERMS & CONDITIONS

By participating you agree to the Terms & Conditions and Safety Rules & Restriction Guidelines below. You should be in good health to participate in physical activity and participate in accordance with these rules. It is the parents/guardians responsibility to ensure that their children adhere to these safety rules. Cyberpunk Ninja is not recommended for guests that have neck or back problems, heart problems or have had recent surgery. If you are pregnant, you are not permitted to participate. If you encounter any problems or have any pre-existing medical conditions please discuss these with a staff member of Cyberpunk Ninja.

By agreeing to these Terms and Conditions, you acknowledge that Cyberpunk Ninja can be a dangerous pastime with inherent risks and hazards and as a consequence personal injury and sometimes death can occur and you assume and accept all such risks. Cyberpunk Ninja has taken every possible step to ensure that you have a completely safe and fun experience through the use of high quality harnesses and the employment of a qualified and experienced team. However, we cannot accept any responsibility for injuries sustained due to negligence on the part of the participants. For you to enter the arena, we will require that you confirm that you accept responsibility for you and your party during your time in the Cyberpunk Ninja arena.

Subject to the provisions in this agreement, you release, discharge and forever hold harmless Cyberpunk Ninja, its employees, directors and agents from all liability, obligation and responsibility of any nature for death or for any losses, damages or injuries relating to or arising directly or indirectly from your engagement in the recreational activity and from your participation in any related or incidental activities.

This Release shall be binding on your Estate and may be pleaded by Cyberpunk Ninja as a complete bar in relation to any action, suit, claim or demand of any nature that you may bring against Cyberpunk Ninja or which may be brought on your behalf. This Release shall extend and shall apply to all conduct of Cyberpunk Ninja including, without limitation, the circumstances where the facilities pursuant to which the recreational activity takes place were not supplied with due care and skill or not fit for purpose or because of negligence, breach of contract, statute or statutory duty by Cyberpunk Ninja. In no event shall Cyberpunk Ninja be liable for loss of profit or consequential damages, whether based on breaches of contract, warranty or otherwise.

1. Entry price includes the hire of the full safety equipment, a 10 minute introduction and safety briefing included in a 1 hour climbing session.
2. Please arrive 30 minutes prior to your booked session for processing, harnessing up and your 10 minute safety briefing.
3. Participants must be a minimum of 8 years of age with a minimum weight of 20kg to use the climbing facilities in Cyberpunk Ninja.
4. Parents/Guardians remain responsible for their child’s welfare at all times
   Please note: children aged 13 and under must be accompanied by a responsible adult and be present during the session. Unaccompanied children will not be allowed to participate and will lose their booked session. Exception for After School Programme attendees.
   If one parent or guardian is bringing multiple children, some of which are not his/her own, that adult is responsible for that group.
5. All bookings are subject to our Booking/Cancellation/Refund Policy stated in Terms and Conditions.
6. Participants must follow the below Safety Rules and Restriction Guidelines:

All transactions are in New Zealand Dollars (GST inclusive). Fees and charges are shown on the Cyberpunk Ninja website and at the venue and are subject to change without notice. Booking online in advance is recommended to ensure space is available. You are required to pay the session fee in full prior to being admitted into that session. Tickets/passes issued remain the property of Cyberpunk Ninja and are void if tampered with. 10 Session Passes, Family Passes and Gift Certificates are non-refundable and void after the 12 month expiry date. All Cyberpunk Ninja  tickets/passes are valid only for the date and time shown and may not, without the prior written consent of Cyberpunk Ninja, be resold or offered for resale at a premium or used for advertising, promotion or other commercial purposes either by you as the original purchaser or any subsequent bearer.

You acknowledge that despite Cyberpunk Ninja’s reasonable precautions, Cyberpunk Ninja products and services may be listed at an incorrect price, with incorrect information, or which are unavailable due to an error or oversight. In these circumstances, Cyberpunk Ninja reserves the right to cancel the transaction, notwithstanding that your booking has been confirmed and your credit card has been charged.

General Admission Cyberpunk Ninja Bookings: At Cyberpunk Ninja, all casual Cyberpunk Ninja session bookings are NON-REFUNDABLE but can be rescheduled once less a $5 transaction fee per transaction. Rescheduling is subject to availability. To reschedule, you need to email Cyberpunk Ninja on info@cyberpunkninja.co.nz giving at least the below minimum period of prior notice, and make the appropriate arrangements with one of our staff with the new date and time which will require confirmation by an email from Cyberpunk Ninja. Please Note: Booking Fee is 100% NON-REFUNDABLE.

• Bookings for less than 10 participants – Should you need to reschedule your session for whatever reason, we will require a minimum of 48 hour notice prior to your booked session. Unfortunately, we are unable to offer any rescheduling if less than a 48 hour notice is given and then the booking/cancellation/refund policy applies.
• Bookings for more than 10 participants – Should you need to reschedule your session for whatever reason, we will require a minimum of 7 day notice prior to your booked session. Unfortunately, we are unable to offer any rescheduling if less than a 7 day notice is given and then the booking/cancellation/refund policy applies.
• After School Programme – Should you need to reschedule your 9 week After School Programme for whatever reason, we will require a minimum of 7 day notice prior to the starting date of your booked After School Programme. Unfortunately, we are unable to offer any re-scheduling if less than a 7 day notice is given and then the booking/cancellation/ refund policy applies.

At Cyberpunk Ninja, you are eligible to make amendments or cancellation for any Corporate, Exclusive, Group, Party or School bookings giving at least the below minimum period of prior notice, and make the appropriate arrangements with one of our staff followed by a confirmation email or text from Cyberpunk Ninja. To make any changes, please email Cyberpunk Ninja on info@cyberpunkninja.co.nz Please Note: Booking Fee is 100% NON-REFUNDABLE.

• Catering Option Amendment – Should you need to make any amendments to the catering options for your booking for whatever reason, we will require a minimum of 7 day notice prior to your booking. Unfortunately, we are unable to make any catering changes if less than a 7 day notice is given.
• Rescheduling your Booking – Should you need to reschedule your booking for whatever reason, we will need a minimum of 7 day notice. You are entitled to reschedule once less a $5 transaction fee per booking. Unfortunately, we are unable to offer any rescheduling if less than a 7 day notice is given.
• Partial Cancellation of your Booking – Should you need to cancel part of your booking for whatever reason, we will need a minimum of 7 day notice for you to qualify for a refund less a $5 booking fee per transaction. Unfortunately, we are unable to offer any refunds if less than a 7 day notice is given.
• Cancellation of your Booking – Should you need to cancel your booking for whatever reason, we will need a minimum of 7 day notice for you to qualify for a refund less a $50 cancellation fee per booking. Unfortunately, we are unable to offer any refunds if less than a 7 day notice is given.
• Please note there will be NO REFUND for no-shows on the day.

Children must be at least 8 years of age with a minimum weight of 20kg to use the facilities in Cyberpunk Ninja.

Children aged 13 and under must be supervised by a responsible adult. The adult responsible for such children agrees to be bound by these General Terms and Conditions on their behalf and will directly supervise the child at all times.

You acknowledge and are aware that the physical and mental exertion required to engage in the recreational activity and/or to participate in the activity can activate or aggravate a pre-existing physical condition, so you are required to be in good health and free from any adverse medical conditions. You are not permitted to participate if you are pregnant, impaired by a medical condition or are wearing a cast. You should seek medical advice if you are in doubt about your health. You agree to pay the cost of and authorise Cyberpunk Ninja to take all steps it considers reasonably necessary to protect your welfare in the event of personal injury, including the administration of any emergency medical treatment and ambulance transportation.

No outside food or drinks is permitted inside Cyberpunk Ninja.

Actions of Others: You acknowledge that that there are inherent risks that may arise from the actions of other participants and/or spectators that are not condoned by Cyberpunk Ninja, but which may nevertheless still occur, which include pedestrian traffic, irresponsible, unreasonable, excessive, reckless, careless, unkind, wanton and generally objectionable behaviour whether intentional or unintentional.

Cyberpunk Ninja holds the right to refuse entry or cancel your access to use the facility if you:

• reasonably appear to be under the influence or in the possession of alcohol or illicit substances;
• fail to comply with Safety Rules and Restriction Guidelines and/or fail to follow the instructions of Cyberpunk Ninja staff;
• behave in an offensive, reckless, careless or threatening manner to other customers or staff; and
• are reasonably deemed to be a danger to yourself, other customers or Cyberpunk Ninja staff.

You acknowledge and give consent that, upon entering the Cyberpunk Ninja premises, you and children for whom you are responsible for may be photographed and/or videoed for security, safety and promotional purposes. By providing your email to Cyberpunk Ninja you consent to receiving promotional and advertising material from time to time.
